Dwight W. Scott, Jr. is a founding shareholder of Scott Patton PC. Dwight brings a unique blend of administrative and legal experience to the firm, having over twenty years of combined administrative management and legal experience in the healthcare industry. Before private practice, Dwight worked in-house for a large hospital system where he maintained responsibility for various legal and administrative matters. Immediately prior to forming Scott Patton PC, Dwight worked for a large full service law firm, where he was elected to the Firm’s Management Committee and headed up the Firm’s Health Care practice.

While Dwight serves many diverse practice areas, he focuses his legal efforts in matters affecting healthcare providers and organizations, including peer review, regulatory and administrative compliance, operations, licensure, risk management, medical malpractice and commercial disputes. He frequently advises clients on federal and state compliance issues, including Stark, Anti-Kickback, EMTALA and HIPAA compliance. Dwight is also a certified mediator. Some of his more recent work includes:

  • Representation of health care client in the review and negotiation of multi-million dollar computerized tomography equipment leasing and service agreement with manufacturer.
  • Representation of health care client in arbitration proceedings against large national health insurance carrier regarding improper reimbursements for care to enrolled beneficiaries.
  • Representation of Medical Executive Committee of large national hospital system in internal peer and quality review investigation including adversarial due process proceedings.
  • Representation of health care client in an alleged "over billing" investigation by the United States Office of Inspector General.
  • Representation of a health care client on potential compliance issues involving federal anti-kickback statute, Texas anti-solicitation statute, Stark, False Claims Act, Tax Exemption, Intermediate Sanctions and Provider Based Status Rules.
  • Representation of a health care client following the theft of 1,100 pages of documents containing protected health information of 2,100 patients including the advisement and counsel on privacy rules and disclosure requirements.
  • Representation of a health care client in the investigation, coordination and preparation of timely corrective action plans for the Center for Medicare and Medicaid Services (CMS) and Texas Department of State Health Services (TDSHS) for alleged Emergency Medical Treatment and Active Labor Act (EMTALA) violations regarding the treatment and transfer of patients.
  • Representation of a health care client in the investigation, coordination and preparation of a timely corrective action plan for the Texas Department of Aging and Disability Services (DADS) regarding alleged improper coordination of care of home health and rehabilitation services to pediatric patients.
  • Representation of national health care company in the investigation, coordination and preparation in a timely corrective action plan for TDSHS' Radiation Control Program regarding citations alleging improper safety monitoring of employees.
  • Representation of large national health care client in the investigation and coordination of an external investigation regarding a patient care issue involving the United States Food and Drug Administration (FDA), Centers for Disease Control (CDC) and Texas Department of State Health Services (TDSHS).

Dan Patton is a founding shareholder of Scott Patton PC. He is Board Certified in Labor and Employment Law by the Texas Board of Legal Specialization, a Certified Mediator, and has been appointed Special Master, Mediator, and Receiver for the 127th and 164th Judicial District Courts in Harris County, Texas. While Dan serves many diverse practice areas, his focus is on handling employment and commercial litigation matters. He has represented Fortune 500 companies and a national health care company in all phases of litigation in several state and federal courts throughout Texas. Lisa Turboff

Lisa has over 20 years of experience handling a wide variety of complex health care and litigation matters. She has worked with clients in all types of disputes including civil trials, administrative and professional board proceedings, contract disputes, negotiated resolutions and appeals. Her representation includes leading Texas Medical Center hospitals, international pharmaceutical companies, international tire businesses, health care services organizations, limited liability corporations and individual professionals.

Lisa has extensive experience in coordinating and managing large scale, complex multiparty nationwide litigation. As a lead and principal attorney in multiple mass tort cases, she developed and oversaw effective, standardized procedures and protocols related to nationwide document management, discovery and evidentiary issues as well as managed a team of attorneys from multiple law firms.

Lisa also has a particular interest in medical and technical issues including taking direct and cross examination testimony from a wide variety of medical and technical expert witnesses as well as challenging the qualifications and substantive opinions of opposing medical and technical expert witnesses. She has overseen medical and technical expert witness issues in thousands of medical negligence and product liability cases.

Carolyn Capoccia Smith

Ms. Smith has a unique blend of healthcare and risk management experience, having worked more than eight years as a registered nurse and an organ transplant coordinator prior to becoming an attorney. She previously worked as Senior Counsel and Administrative Director of Risk Management with a nationwide health care system where she was responsible for various legal and risk management issues including nursing and physician peer review, guidance of hospital committees, and management of claims and litigation activities. As a nurse and former in house counsel, Ms. Smith approaches her representation of her clients with a keen awareness of her clients’ point of view.

Ms. Smith focuses her legal efforts in matters affecting healthcare providers and organizations, including medical malpractice disputes, licensure, consent issues, credentialing, peer review, risk management, adverse patient events, disclosure, and regulatory compliance.

Cheryl Blount

Cheryl Blount is an associate at Scott Patton PC. She has experience in a variety of civil litigation matters, including personal injury, products liability, and construction defect cases. Her current practice focuses on health care, employment, and commercial litigation.

Cheryl attended the University of Texas at Austin and graduated with honors with a Bachelor of Science in Sports Management in 2006. After working for two years, she earned her law degree from Baylor University School of Law, where she graduated cum laude.

While in law school, Cheryl served as an Articles and Executive Editor on Baylor Law Review and was a member of the Order of the Barristers. She was also an intern for the Honorable Judge Nancy F. Atlas of the U.S. District Court of the Southern District of Texas and Justice Nathan Hecht of the Supreme Court of Texas.

Prior to joining Scott Patton PC, Jarod practiced at a well-respected commercial litigation firm in Houston, Texas, where he worked on various complex and high-stakes commercial matters.  He has represented numerous Fortune 500 companies in litigation and appeals in several state and federal courts throughout Texas and the United States.
